TERMS AND CONDITIONS

AGREEMENT TO OUR LEGAL TERMS

We are Mow and Snow Technologies Inc., doing business as Mow & Snow, Mow and Snow, MS, and M & S (“Company,” “we,” “us,” “our”), a company registered in Canada with a mailing address at Box 64, Plenty, Saskatchewan S0L 2R0.

We operate the Mow & Snow mobile application (the “App”), as well as any related websites, services, and platforms that reference these terms (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these legal terms (the “Terms”). If you do not agree, you must not use the Services.

We may update these Terms at any time. We will notify users via email and/or in-app notification.

  1. SCOPE OF SERVICES

Mow and Snow Technologies Inc. provides a platform that connects customers with independent third-party contractors for on-demand lawn mowing and snow removal. We are not a provider of those services and do not supervise, direct, or control contractors.

  1. INTELLECTUAL PROPERTY RIGHTS

All content, code, functionality, trademarks, logos, designs, and documentation on the Services (the “Content”) are owned by or licensed to Mow and Snow. The Content is protected under Canadian and international copyright and trademark laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for your personal use. Any reproduction, distribution, or commercial exploitation is strictly prohibited without prior written permission.

  1. MOBILE APPLICATION LICENSE

We grant you a limited license to install and use the App on personal devices for lawful purposes. You must not:

  • Decompile, reverse engineer, or tamper with the App;
  • Use the App to build a competing service;
  • Share or sublicense the App;
  • Remove proprietary notices or trademarks.

If downloaded from Apple or Google, you must comply with their respective terms.

  1. USER-GENERATED CONTENT

You may submit content including ratings, reviews, photos, or suggestions (“User Content”). By doing so, you grant us a perpetual, royalty-free, worldwide license to use, reproduce, distribute, and modify your content.

You represent that your content is accurate, does not violate others’ rights, and complies with applicable law. We may remove content at our discretion.

  1. USER CONDUCT

You agree to act respectfully and professionally. The following is strictly prohibited:

  • Harassment, hate speech, or abusive behavior;
  • Circumventing the App’s payment or communication systems;
  • Impersonation of others or providing false information;
  • Attempting unauthorized access to our systems.

Violation may result in suspension or termination.

  1. CONTRACTOR ELIGIBILITY & BACKGROUND CHECKS

Contractors must be 18+ and legally eligible to work in Canada. A valid, clear Canadian Criminal Background Check is required prior to activation.

We may deny or revoke access at any time, including for misrepresentation or failure to meet standards.

  1. STRIKE POLICY AND CONTRACTOR REMOVAL

Contractors are subject to a strike system for:

  • Missed jobs or poor workmanship;
  • Customer complaints;
  • Incomplete services or misconduct.

Three (3) strikes may lead to termination. However, we may suspend or remove a contractor at any time at our sole discretion.

  1. NO EMPLOYMENT RELATIONSHIP

Contractors are independent service providers. No employment, partnership, agency, or joint venture is created. Contractors are responsible for their own taxes, insurance, and equipment.

  1. OFF-PLATFORM SOLICITATION

Users must not:

  • Arrange or accept jobs outside the App;
  • Evade platform fees;
  • Exchange personal contact info to bypass the platform.

Violation may lead to termination and recovery of avoided fees or liquidated damages.

  1. ASSUMPTION OF RISK

You acknowledge risks in using third-party services. Mow and Snow is not liable for injuries, damages, or dissatisfaction caused by contractors. You assume full responsibility and release us from all related claims.

  1. FRAUD PREVENTION & PAYMENT DISPUTES

We monitor for fraud, including:

  • Unauthorized payments or chargebacks;
  • Account impersonation;
  • False identity claims.

We may suspend accounts or pursue legal action. Users are liable for costs arising from chargebacks or fraudulent disputes.

  1. SERVICE QUALITY

Contractors must deliver services with care, diligence, and professionalism. Repeated complaints or low-quality work may result in suspension or removal from the platform.

  1. INSURANCE AND LIABILITY

We encourage contractors to carry liability insurance, but do not require it. Mow and Snow assumes no liability for acts or omissions of contractors.

  1. WEATHER AND SAFETY

Service delays may occur due to severe weather or safety issues. We prioritize safety and appreciate your understanding.

  1. PRIVACY POLICY

We collect, use, and store your personal information in accordance with our Privacy Policy. We comply with PIPEDA and Canadian privacy laws.

  1. COPYRIGHT INFRINGEMENT

If you believe your intellectual property is being used improperly, contact us at info@mowandsnows.com. We may remove the disputed content during our investigation.

  1. TERM AND TERMINATION

These Terms remain in effect until terminated. We may terminate or suspend your account at any time for any reason, including breach of Terms or law. You may terminate by contacting us via email.

  1. MODIFICATIONS AND INTERRUPTIONS

We may change or discontinue any aspect of the Services at any time. We are not responsible for downtime or disruptions beyond our control.

  1. GOVERNING LAW

These Terms are governed by the laws of the Province of Saskatchewan and the laws of Canada, without regard to conflict of laws.

  1. DISPUTE RESOLUTION

Informal Negotiation

Users must attempt informal resolution by emailing info@mowandsnows.com. If unresolved within 30 days:

Arbitration

Disputes will be resolved by binding arbitration under the rules of the ADR Institute of Saskatchewan, in Saskatoon, in English, with one arbitrator.

No Class Actions

Disputes must be pursued individually — not on a class or collective basis.

  1. CORRECTIONS

We may correct errors, inaccuracies, or omissions in the Services at any time without notice.

  1. DISCLAIMER

The Services are provided “as-is.” We disclaim all warranties, express or implied, including merchantability, fitness for purpose, and non-infringement. Use at your own risk.

  1. LIMITATION OF LIABILITY

To the fullest extent allowed by law, we are not liable for any indirect, incidental, or consequential damages. Our total liability is limited to the amount paid to us in the 12 months prior to the claim.

  1. INDEMNIFICATION

You agree to indemnify and hold harmless Mow and Snow and its affiliates for any claims, damages, or losses arising from your use of the Services, breach of Terms, or contractor services.

  1. USER DATA

We retain data as necessary to operate the platform. While we implement security safeguards, we are not liable for data loss. You are responsible for backing up your information.

  1. ELECTRONIC COMMUNICATIONS & SIGNATURES

You consent to electronic communications, records, and signatures. These satisfy legal requirements for written documents and notices.

  1. SMS TEXT MESSAGING

By using the Services, you consent to receive SMS communications. You may opt out by replying “STOP.” Standard messaging rates may apply.

  1. MISCELLANEOUS

These Terms constitute the entire agreement between you and us. If any part is found invalid, the remainder still applies. We may assign our rights without notice.

  1. MODIFICATION OF TERMS

We may update these Terms at any time. Continued use after changes constitutes acceptance. Users will be notified of material changes.

  1. PRICING AND PAYMENT

All service prices are fixed and shown in the App. No bidding or negotiation occurs. Payment is processed securely via Stripe or other third-party payment providers.

  1. CANCELLATION POLICY

Jobs cannot be cancelled once accepted by a contractor. This is enforced within the App for mutual clarity and accountability.

  1. USER RATINGS AND REVIEWS

Customers may rate contractors after a job. These ratings help maintain quality and may affect a contractor’s status. Reviews are not publicly displayed.

  1. SERVICE LOCATIONS

Mow and Snow operates in:

Alberta: Calgary, Edmonton, Airdrie, Red Deer, Medicine Hat, Lloydminster
Saskatchewan: Saskatoon, Regina, Martensville, Warman, Lloydminster
Manitoba: Winnipeg, Brandon
Ontario: Toronto, Mississauga, Markham, London, Windsor, Kitchener, Hamilton

  1. CONTESTS AND PROMOTIONS

From time to time, we may offer promotional contests, giveaways, or limited-time offers (the “Promotions”) to users of the Services. These Promotions may be subject to additional terms, conditions, and eligibility requirements.

By participating in any Promotion, including the Mow & Snow Elite Members Contest, you agree to be bound by the official contest rules available at mowandsnows.com/contest-rules, which are hereby incorporated into these Terms by reference.

Eligibility for prizes may depend on your membership status, location, age, and compliance with applicable laws. Contest entries may require either the purchase of an Elite Lawn Care Plan or a free entry through an online form. No purchase is necessary to enter the gift card draw. Contest is open to Canadian residents (excluding Quebec), age 18 and over.

We reserve the right to modify or cancel any Promotion at any time, and to verify the eligibility of all participants. Winners must correctly answer a skill-testing question to claim a prize.
